Protection of State and Local Power

Section 1: Given the inevitable conflict between the interests of commerce and the well being of the people, to protect its environment, economy, and natural resources a state or lesser jurisdiction thereof may enact and enforce laws or regulations involving environmental protections or business operating conditions that are more stringent than those of superior jurisdictions, including the federal government.

Section 2: All violations of environmental protection laws involving damage in excess of $10,000 shall be felonies punishable by mandatory maximum-security incarceration for a period, not be subject to pardon, suspension, commutation, parole, or other reduction of sentence, of not less than five years.

Section 3: A state may enact and enforce on financial institutions and insurance companies doing business within its borders, or with its residents, laws and regulations more stringent than those imposed by the federal government and its agencies or chartered entities. All violations involving financial fraud in excess of $10,000 shall be felonies punishable by maximum-security incarceration for a period, not subject to pardon, parole, commutation, or other reduction of sentence of at least ten years.
